By downloading, installing, or using VizFX AI Coloring ("the App"), or other variations of the name such as VizFX AI Animated Coloring, VizFX AI Coloring Fun, identified by the same APP ID, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is owned and operated by Yasin Yakub ("Developer").

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and Yasin Yakub ("Developer") regarding your use of VizFX AI Coloring. By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. ELIGIBILITY

You must be of legal age to create an Apple ID or email account in your jurisdiction to use the App. If a parent or adult signs in and allows a child to use the App, the parent/adult remains fully responsible for all activities conducted through the account.

3. ACCOUNT INFORMATION

When you sign in with Apple ID, we store a hashed identifier rather than your email address. Each user is assigned a unique account ID visible in the settings page. All purchases and coin balances are tied to this account ID. This ID will be used for support purposes if needed.

4. SUBSCRIPTION AND PURCHASES

The App offers Monthly Premium and Annual Premium subscription options. Current pricing is displayed in the App Store or during purchase.

Subscriptions automatically renew unless canceled through your Apple account settings at least 24 hours before the end of the current period. You are responsible for managing your subscription.

Users can purchase coins through the settings page. Coins can be used to generate coloring pages within the App.

No refunds will be provided for any purchases or subscriptions. For assistance, contact [email protected].

5. USER CONTENT AND CONDUCT

All content created using the App must be suitable for a general audience. If you share content on social media or publicly, it must be safe for the intended audience, follow all legal guidelines of your country of residence, and not bring disrepute to or place blame on the App or Developer.

You may not use the App to create or distribute illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content; infringe upon intellectual property rights of others; engage in any illegal activities; or attempt to manipulate, hack, or disrupt the App's functionality.

6. INTELLECTUAL PROPERTY RIGHTS

All pre-generated content, assets, features, and functionalities provided in the App are the intellectual property of the Developer and are protected by copyright, trademark, and other intellectual property laws.

Content generated by subscribed users through the AI generation feature belongs to the user. Pre-generated content remains the property of the Developer.

Users may use their AI-generated content for commercial purposes. For commercial use of pre-generated content, users must contact the Developer for permission.

7. LIMITATIONS OF LIABILITY

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

The Developer uses third-party AI models for generating images. Due to the nature of AI, certain limitations in functionality may occur. The Developer is not responsible for not meeting user expectations regarding prompts and corresponding content.

In no case will the user sue for any claims, losses, liabilities, damages, costs, or expenses attributable to any failure in the App. The Developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages.

All user-generated data is stored on the user's device. The Developer does not provide any backups, and the user is solely responsible for backing up their data.

8. MODIFICATIONS TO SERVICE

The App and its pre-generated content can be modified (including deletion of coloring pages and animations) at any time with or without notice to the user.

9. TERMINATION

The Developer may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach the Terms. Upon termination, your right to use the App will cease immediately. No refunds will be provided.

Your account may be terminated if you violate these Terms or perform activities illegal in your country of residence.

10. ACCOUNT DELETION

You may delete your account at any time through the settings page within the App. Upon account deletion, all user-related data, information associated with consumable purchases, and any remaining balance of AI coins in the account will be permanently deleted and cannot be recovered. Subscription management is handled separately through Apple; to change or cancel your subscription, please go to Manage Subscriptions. Any locally created data on your device will remain untouched after account deletion and must be removed by you if desired.

11. DISPUTE RESOLUTION

These Terms shall be governed by the laws of India.

All disputes must be resolved directly with the Developer. Any legal proceedings shall be brought exclusively in the courts of Bangalore, India.
